Terms of service

1. Agreement

These Terms of Service ("Terms") govern your use of Boom-Board (the "Service"), a digital signage product offered by Boom-List and its affiliates ("we," "us," or "Boom-List"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Boom-Board is a subset of the Boom-List company products. General policies, privacy practices, and additional terms that apply to Boom-List offerings may also apply to you. You should review the terms published at boom-list.com/terms ("Boom-List Terms"). Where these Terms and the Boom-List Terms conflict on a matter specific to Boom-Board, these Terms control for the Service; otherwise, the Boom-List Terms supplement these Terms.

2. The Service

Boom-Board provides tools to upload, organize, and display media (including images and video in accordance with product capabilities) on supported devices such as Android TV and Chromecast, with additional platforms planned. The Service may include slideshows, optional overlays (such as logos and text), branding features, and integration of promotional or advertising content as configured in your account.

We may update, modify, or discontinue features with reasonable notice where practicable. We do not guarantee uninterrupted or error-free operation.

3. Accounts and security

You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. You must provide accurate registration information. Notify us promptly of unauthorized use.

4. Your content and intellectual property

You represent and warrant that you own or have obtained all necessary rights, licenses, and permissions to use, display, and distribute any content you upload or configure through the Service, including photographs, videos, logos, text, menus, product imagery, and advertising creative ("Your Content"). You are solely responsible for ensuring Your Content does not infringe third-party rights or violate applicable law.

Except for collections submitted for publication, Boom-Board and Boom-List do not claim ownership of Your Content and do not assume responsibility for its legality, accuracy, or appropriateness. The Service is a display and distribution mechanism. You retain responsibility for all intellectual property, proprietary, and compliance issues associated with Your Content.

When you submit a collection to be published, listed, reviewed, displayed, distributed, or otherwise made available through Boom-Board, Boom-List, or any related catalog, directory, promotional, or public-facing product, you assign and transfer all ownership, copyright, title, and interest in that submitted collection to Boom-Board and Boom-List. You waive any ownership, copyright, attribution, royalty, compensation, approval, or other claim in that collection after submission. Boom-Board and Boom-List may publish, modify, combine, distribute, sublicense, monetize, advertise with, remove, or otherwise use submitted collections and their component media in any manner either entity chooses, without further notice or payment to you.

To operate the Service, you grant us a limited license to host, process, transmit, and display Your Content as instructed by your account settings and as technically required (for example, transcoding, caching, or delivery to your screens).

5. Loss or deletion of content

To the fullest extent permitted by law, Boom-Board and Boom-List are not liable for any loss, corruption, or deletion of Your Content or related data, whether caused by software error, hardware failure, user action, subscription status, account termination, third-party services, or any other cause.

You expressly understand and agree that you use the Service at your own risk regarding preservation of Your Content and that you should maintain independent backups of any material you cannot afford to lose.

You release and hold harmless Boom-Board and Boom-List from any claims, damages, or losses arising from or related to lost, deleted, or unavailable photos, videos, or other media, including loss of business, revenue, goodwill, or intellectual property value.

6. Subscription and payment

Paid features are described on our pricing and billing pages. Fees, taxes, and renewal terms are as presented at checkout or in your account. Failure to pay may result in suspension or termination of access. See Stripe-related communications for payment disputes where applicable.

7. Acceptable use

You will not misuse the Service, including by attempting unauthorized access, interfering with other users, distributing malware, or displaying unlawful content. We may suspend or terminate accounts that violate these Terms or applicable law.

8. Content moderation, removal, and law enforcement

We may remove, disable, or restrict access to any content—including photos, videos, logos, text, or advertising—at our sole discretion if we believe it is inappropriate, unlawful, harmful, or not a good reflection of our business or not useful to the public in general. We may take such action without prior notice where reasonable.

We will turn over any and all illegal images and related records to law enforcement authorities when we believe doing so is legally required or appropriate to protect safety, children, or the public. Nothing in these Terms requires us to monitor all content at all times, but we reserve the right to review and act on reports and on content we become aware of. You may report concerns through our Report abuse page.

9. DMCA, copyright notices, and complaints

We will honor good-faith initial requests for DMCA and other copyright-related takedowns in accordance with applicable law and our operational policies.

We reserve the right to allow our customers a reasonable opportunity to receive notice of, respond to, or challenge such claims before we take final action, where permitted by law.

You assume full responsibility and liability for ensuring that you have permission and the legal right to display any photos, videos, logos, advertising, or other content you upload or configure for display through the Service, including on your screens. This supplements the representations in Section 4 and applies to all content you cause to be shown using Boom-Board.

Copyright, abuse, and similar complaints may be submitted through our Report abuse page or by email to complaints@boom-list.com.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT WHERE PROHIBITED BY LAW.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BOOM-BOARD, BOOM-LIST, OR THEIR SUPPLIERS OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.

12. Indemnity

You agree to indemnify and hold harmless Boom-Board, Boom-List, and their officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service, or your violation of these Terms.

13. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms, non-payment, or operational reasons, subject to applicable law and any commitments made at purchase.

14. Changes

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Continued use after changes constitutes acceptance of the revised Terms where permitted by law.
